Tesla starts paid Cybercab rides in Austin and NHTSA opens an audit the same day

According to the NHTSA Office of Defects Investigation resume for AQ26002, “On September 3, 2026, Tesla began commercial deployment with a small number of its Cybercab vehicles in Austin, Texas.” The agency opened the audit query the same day. The estimated population is 1,000 vehicles, and the subject line is “Tesla Cybercab FMVSS Certification.”

What NHTSA is examining is not how well the vehicle drives. It is the paperwork behind the vehicle’s existence. The Cybercab, in the agency’s words, lacks “permanently attached, conventional manual controls, such as a brake pedal, gas pedal, steering wheel, and mirrors.” Tesla told NHTSA it had self-certified those vehicles as compliant with all applicable Federal Motor Vehicle Safety Standards rather than applying for an exemption. The audit query will “examine the process and technical data on which Tesla relied when certifying the Cybercab,” and specifically “the extent to which Tesla’s certification depended on determinations that certain FMVSS are inapplicable to the Cybercab.”

That distinction is the whole story. Amazon’s Zoox, whose purpose-built robotaxi also has no steering wheel or pedals, went through NHTSA’s Part 555 exemption process and waited years for it. Tesla took the position that the standards written around a human driver simply do not apply when there is no human driver, and shipped. An audit query is an enforcement tool for probing the basis of a self-certification; opening one establishes no defect and no violation.

For anyone deploying autonomous hardware, this is the live regulatory question of the decade in miniature: when a safety standard is written in terms of a component you have deliberately removed, is the standard satisfied, inapplicable, or violated? Tesla has now forced a federal answer, on the record, with a fleet already collecting fares while the question is open.
